Bearer agrees that he/she may not use any 4 the Love of Photography images for commercial or editorial purposes, or enter any of 4 the Love of Photography images into competition without the express written permission of 4 the Love of Photography.
4 the Love of Photography retains the copyright to all images, per USC Title 17 (US Copyright Law). If you are caught stealing you will be prosecuted in Federal Court in the State of Arizona. Do not take this lightly!
Basically, when a photographer creates an image, at that very moment that image is copyrighted and this gives the photographer or creator of the image the exclusive right to copy, edit, distribute, post on facebook, blog, etc. etc. etc. by sale or transfer. These rights, given to the photographer or creator of the image, by The Copyright Act, therefore make it illegal for anyone else (even if you are in the image but as long as you have signed a model release) to copy, scan, edit, print, distribute digital or printed versions of the image without the photographer’s permission. This is a Federal Law and can be prosecuted as such. This is serious-it is stealing. And this copyright lasts for 70 years after the company no long exists or the photographer is dead (the creator of the image) so after that people, its a free for all! That means that if we do your newborn images and die the next day, when your baby is 70 they can do whatever they want with the images-cool huh?
Copyright and Licensing Notice
The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: sharing via social media, displaying in your house, keeping them on your person. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.
You hereby grant to 4 the Love of Photography the right to use and publish images and photographs taken at your photography session to further promote its services, including portfolio, web site, display, advertisement, and editorial use. 4 the Love of Photography agrees to limit the use of these images and photographs to promotional use only.
So I can print from Facebook?
No. We own the copyright to those images and give explicit permission for people to tag themselves, share the link, etc. without cropping out our logo and also making sure they are giving us credit-that is the only right to those images posted-no printing, no downloading, no screen grabs, etc. The images are sized in such a way they won’t make good prints anyway, which makes it even worse if someone does print them-it makes our work look bad. That is another reason it is simply not allowed.
4 the Love of Photography may revoke this license at any time and for any reason.
4 the Love of Photography retains all copyrights to the images and derivative works thereof.
